These Terms of Service (“Terms”) govern your access to the website toasttocoast.net (the “Site”) and your booking and participation in the day-trip transportation services of Toast to Coast LLC (“Toast to Coast,” “we,” “us,” “our”) (the “Services”). By using the Site or booking a trip, you agree to these Terms. If you do not agree, please do not use the Site or book a trip.

1. Who We Are & Eligibility

Toast to Coast LLC is an Oregon limited liability company. You must be 18 years of age or older to book and to travel, and our Services are intended for adults. By booking, you confirm that you are 18 or older and that the information you provide is accurate and complete.

2. The Services

We provide round-trip van transportation, driven by us, from a designated Portland-area departure point (identified in your booking confirmation) to destinations along the Oregon Coast, where guests get out to walk, explore, and sightsee at their own pace. What is included in each trip (such as transportation, snacks, and non-alcoholic beverages) is described on that trip’s listing; meals, shopping, and admissions are not included unless stated. We may modify, substitute, or discontinue trips, stops, routes, or features.

3. Booking & Payment

Reservations and payments are made through our booking provider, Bookeo, and our payment processor, Stripe. Prices are in U.S. dollars and may change before you book. Your reservation is confirmed only when you receive a confirmation from us or Bookeo. Seats are limited and offered on a first-come basis. You authorize us and our providers to charge your selected payment method for the total shown at checkout.

4. Cancellations, Changes & Refunds

Cancellations, changes, and refunds — by you or by us — are governed by our Cancellation & Refund Policy, which is incorporated into these Terms. Each trip requires a minimum of 5 guests to operate.

5. Health, Mobility & Assumption of Risk

Our trips are designed for a relaxed pace and with accessibility in mind, but coastal walking and outdoor activity involve inherent risks. You are responsible for assessing whether a trip is suitable for your health and mobility, for disclosing accessibility or medical needs in advance so we can try to accommodate you, and for following the driver’s reasonable safety instructions. Participation requires signing our Release of Liability & Assumption of Risk (the “Waiver”), which is incorporated by reference. For matters of personal-injury liability, the Waiver and applicable Oregon law — including 2026 Oregon Laws chapter 132 — control.

6. Changes by Us; Weather & Itinerary

We may adjust a trip’s itinerary, stops, timing, route, or destinations for reasons including weather, road or surf conditions, safety, traffic, vehicle availability, or seasonal availability (for example, the seasonal scenic train). Reasonable changes of this kind are not a breach of these Terms. If we cancel a trip, our Cancellation & Refund Policy applies.

7. Force Majeure

We are not liable for any failure or delay in performing the Services caused by events beyond our reasonable control, including severe weather, natural disasters, fire, flood, road or bridge closures, accidents, labor disputes, governmental actions, public-health emergencies, utility or communications failures, or the failure of a third-party supplier. If such an event prevents a trip, we will apply the “If We Cancel” remedy in our Cancellation & Refund Policy.

8. Conduct & Right to Refuse

You agree to follow the driver’s reasonable safety instructions. Toast to Coast provides no alcohol. For the safety and comfort of everyone, we may decline to board, or remove from a trip, any guest whose conduct is unsafe, unlawful, impaired, or disruptive, without refund. You are responsible for your personal belongings.

9. Photography & Media

With your consent (see the Waiver), we may photograph or record guests during trips and use those images in our marketing. You may opt out at any time by emailing info@toasttocoast.net.

10. Third Parties

Restaurants, shops, attractions, excursions (such as the scenic train), Bookeo, Stripe, and other independent businesses are not controlled by Toast to Coast. We are not responsible for their acts, omissions, goods, or services, and your use of them is subject to their own terms.

11. Website Use & Intellectual Property

The Site and its content — including text, images, logos, and design — are owned by or licensed to Toast to Coast and protected by intellectual-property laws. We grant you a limited, personal, non-commercial license to use the Site to learn about and book trips. You may not copy, scrape, resell, or misuse the Site or its content, or interfere with its operation.

12. Disclaimers

To the fullest extent permitted by law, the Site and Services are provided on an “as is” and “as available” basis, and we disclaim implied warranties (such as merchantability and fitness for a particular purpose) regarding the Site. This Section does not limit the inherent-risk and personal-injury terms of the Waiver, which control those subjects.

13. Limitation of Liability

To the fullest extent permitted by Oregon law, Toast to Coast is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the Site or the Services, and our total aggregate liability for any claim relating to the Site or a trip is limited to the amount you paid for the affected trip.

Nothing in these Terms limits any liability that cannot be limited under Oregon law — including liability for gross negligence, recklessness, or intentional misconduct, and including any claim relating to the operation or use of a vehicle. These limitations do not apply to claims for bodily injury, which are governed solely by the Waiver and applicable Oregon law (2026 Oregon Laws chapter 132).

14. Indemnification

You agree to indemnify and hold harmless Toast to Coast and its owner, members, employees, and agents from any claims, damages, losses, or costs arising from your own acts or omissions, your breach of these Terms, or your violation of any third party’s rights. This does not make you responsible for claims caused by our own negligence.

15. Dispute Resolution; Governing Law & Venue

Please contact us first at info@toasttocoast.net so we can try to resolve any concern, and bring any complaint promptly — within 30 days of your trip where possible. These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Any dispute relating to the Site, the Services, or these Terms must be brought only in the state courts located in Clackamas County, Oregon, and you consent to that court’s jurisdiction.

16. Privacy

Your use of the Site and Services is also governed by our Privacy Policy, which is incorporated by reference.

17. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version. If we make material changes, we will post the updated Terms on the Site; your continued use after changes take effect means you accept them.

18. General

These Terms — together with the Waiver, the Cancellation & Refund Policy, and the Privacy Policy — are the entire agreement between you and Toast to Coast regarding the Site and Services. If any provision is held unenforceable, the remaining provisions stay in effect and the unenforceable provision will be limited to the extent permitted by law. You may not assign your rights under these Terms; we may assign ours. Our failure to enforce any provision is not a waiver of it. Section headings are for convenience only.
